Terms and Conditions of Use – RivieraMove

Welcome to RivieraMove, the smart peer-to-peer car rental marketplace in the Mexican Caribbean. By accessing, registering, or using our platform, you agree to comply with these Terms and Conditions. If you do not agree to any part of these terms, please refrain from using our services.

1. Purpose of the Agreement

RivieraMove, operated by Muner Riviera Maya SA de CV, is a digital platform that connects private car owners with individuals who wish to rent their vehicles on a temporary basis. RivieraMove is not the owner of the vehicles listed and does not operate as a traditional car rental company.

2. User Registration and Use

To use RivieraMove as either an owner or a renter, you must:

• Be at least 21 years old
• Provide truthful and up-to-date personal information
• Hold a valid driver’s license (if renting a vehicle)
• Provide current legal documentation of the vehicle (if listing one)

RivieraMove reserves the right to verify your identity, documents, and usage history on the platform.

3. RivieraMove’s Role

RivieraMove facilitates connections, communication, booking, and payment between users. We are not responsible for vehicle use, mechanical condition, accidents, thefts, or damages during the rental period.

Any dispute between parties must be resolved between the renter and the owner, although RivieraMove may act as a mediator at its discretion.

4. Owner Responsibilities

By listing a vehicle, the owner agrees to:

• Be the legal owner of the car or have written authorization to rent it
• Ensure the vehicle is in good working condition, insured, debt-free, and legally documented
• Deliver the vehicle clean, with adequate fuel, and in the agreed condition
• Accept the service commission charged by RivieraMove
• Comply with the platform’s cancellation policies, delivery, and return schedules

5. Renter Responsibilities

By booking a vehicle, the renter agrees to:

• Use the car responsibly for personal or tourism purposes only
• Not use the vehicle for racing, illegal activity, sub-renting, commercial transport, or international travel without written permission
• Return the vehicle on time, in the same condition as received, and at the agreed location
• Cover costs for damages, traffic fines, lost keys, late returns, or excessive cleaning when applicable

6. Payments and Fees

• The renter pays the full amount via the platform, which includes the owner’s rate plus applicable fees
• RivieraMove charges a commission per transaction for using the service
• Owners receive payouts (minus the commission) within up to 5 business days after the vehicle is returned, subject to any incident reports

7. Cancellations and Refunds

• Renters may cancel their booking up to [X hours/days] before the start date without penalty. Late cancellations may incur partial or full charges
• Owners who cancel confirmed bookings may be subject to penalties or account suspension in case of repeated incidents

8. Fines, Damages, and Additional Charges

The renter authorizes RivieraMove to charge their registered payment method for:

• Traffic fines incurred during the rental period
• Verified vehicle damage supported by photo or documentation
• Late returns, low fuel, lost keys, or excessive cleaning

9. Insurance and Liability

• Owners are responsible for maintaining valid insurance coverage on their vehicles
• RivieraMove does not provide insurance and is not liable for incidents, theft, damages, or claims related to rentals
• Renters are encouraged to review insurance coverage before driving

10. Reviews and Conduct

• Owners and renters can review each other after a completed reservation
• RivieraMove reserves the right to suspend or terminate accounts with repeated negative reviews or inappropriate behavior

11. Prohibited Actions

The following are strictly prohibited:

• Providing false information or identity
• Sub-renting vehicles booked through the platform
• Manipulating reviews or interfering with platform functionality
• Using the platform for unauthorized commercial purposes

12. Changes to Terms

RivieraMove may modify these Terms and Conditions at any time. Updates will be published on the website and will take effect immediately upon publication. Users are encouraged to review them regularly.

These Terms shall be governed by the laws of the United Mexican States. Any dispute arising from the interpretation or enforcement of these Terms shall be submitted to the competent courts of Cancún, Quintana Roo, Mexico.
